SmartTill POS – Terms of Use

Welcome to SmartTill POS, a point-of-sale and business management system owned and operated by Code Builders Systems (“we”, “us”, “our”). By creating an account or using SmartTill POS, you agree to these Terms of Use. If you do not agree, you must not use the platform.

1. Acceptance of Terms

By accessing or using SmartTill POS, you confirm that you have read, understood, and agree to be bound by these Terms, as well as any additional policies referenced here (including our Privacy Policy).

2. Eligibility

You must be at least 18 years old and legally authorised to act on behalf of the business or store you register on SmartTill POS.

3. Account Registration

When creating an account, you agree to provide accurate and complete information, including:

• Your full name
• Valid mobile number and email address
• Business / store name and location
• A secure password

You are responsible for keeping your login details confidential and for all activity under your account. If you suspect unauthorised access, you must notify us as soon as possible.

4. Use of the SmartTill POS System

You agree that you will not:

• Use the system for any unlawful, fraudulent or abusive purpose;
• Interfere with or disrupt the performance, security or integrity of the platform;
• Attempt to copy, modify, reverse engineer, resell or exploit the software;
• Upload malicious code, spam or content that infringes any rights of others.

We reserve the right to suspend or terminate accounts that violate these Terms or misuse the platform.

5. Subscriptions, Trials and Payments

SmartTill POS may be offered as a free trial, subscription service or a combination of both. Pricing, trial periods and billing cycles will be communicated on our website or in-app.

We may update pricing from time to time with reasonable notice. Failure to pay applicable fees may result in limited access, suspension or termination of your account.

6. Data Ownership

You retain ownership of the business data you capture in SmartTill POS, including your:

• Sales and transaction records
• Customer information
• Products, stock and pricing

You grant us a limited licence to store, process and back up this data solely for the purpose of providing and improving the SmartTill POS service.

7. System Availability

We aim to provide a highly available service but do not guarantee uninterrupted or error-free operation. Downtime may occur due to maintenance, network issues or third-party service failures.

We are not liable for any indirect loss or damages arising from such interruptions.

8. Limitation of Liability

SmartTill POS is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we are not liable for:

• Loss of profits, revenue, business or goodwill;
• Loss or corruption of data caused by user error, hardware failure or third-party services;
• Any indirect, consequential or special damages of any kind.

Where liability cannot be excluded, our total aggregate liability will not exceed the amount paid by you for SmartTill POS in the three (3) months immediately prior to the event giving rise to the claim.

9. Termination

You may cancel your SmartTill POS account at any time. We may suspend or terminate your account if:

• You breach these Terms or applicable law;
• You engage in fraudulent or abusive activity;
• Required subscription payments are not made.

On termination, your access to the system may be disabled, but we may retain certain records where required by law or for legitimate business purposes (for example, backups for a limited period).

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. By continuing to use SmartTill POS after changes take effect, you accept the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa, and any disputes shall be subject to the jurisdiction of the South African courts.
